These Terms and Conditions ("Terms") govern your use of the website operated by Edinburg Concrete & Masonry at edinburgmasonry.com and the masonry and concrete services we provide. By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use this website or request our services.
By using our website or requesting a service estimate, you confirm that you are at least 18 years of age, have the legal authority to enter into a binding agreement, and agree to these Terms as well as our Privacy Policy. These Terms apply to all visitors, clients, and others who access or use our website or services.
Edinburg Concrete & Masonry is a masonry contractor based in Edinburg, TX. We provide residential and commercial masonry services including but not limited to foundation repair, chimney repair, tuckpointing, brick repair, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, outdoor kitchen masonry, driveway pavers, walkway construction, and related work.
All services are subject to a written estimate and a signed agreement between Edinburg Concrete & Masonry and the client before work begins. We reserve the right to decline any project at our discretion.
Estimates provided by Edinburg Concrete & Masonry are based on the scope of work described or observed at the time of the estimate. An estimate is not a binding contract until both parties have signed a written agreement.
Final pricing may change from the original estimate if the actual scope of work differs materially from what was described or visible at the time of the initial assessment. Any changes to the scope of work will be communicated to the client and require written approval before additional work proceeds.
Estimates are valid for 30 days from the date issued unless otherwise stated in writing. Material cost fluctuations after the estimate period may affect pricing.
Once a project is scheduled, we ask that clients provide at least 48 hours notice if they need to reschedule or cancel. We understand that circumstances change, and we will do our best to accommodate reasonable requests.
Edinburg Concrete & Masonry reserves the right to reschedule work due to weather conditions, material availability, or other circumstances beyond our control. We will notify the client as early as possible in such situations.
If a deposit has been paid and the client cancels with less than 48 hours notice without an agreed-upon reason, a portion of the deposit may be retained to cover preparation and scheduling costs. This will be specified in the written agreement.
Payment terms are set out in the written agreement for each project. In general:
Edinburg Concrete & Masonry reserves the right to suspend or cease work on a project if payment obligations are not met according to the agreed schedule.
For projects that require a building permit under local regulations, Edinburg Concrete & Masonry will advise the client of this requirement. Where included in the written agreement, Edinburg Concrete & Masonry will apply for and manage the permit process on the client's behalf.
The client is responsible for ensuring that the property is free of easement restrictions, deed restrictions, or homeowner association rules that would prohibit the proposed work. Edinburg Concrete & Masonry is not liable for project delays or costs arising from restrictions the client failed to disclose.
Edinburg Concrete & Masonry warrants that work will be performed in a professional manner consistent with industry standards. Any warranty terms specific to a project - including duration and coverage - will be stated in the written agreement for that project.
Warranties do not cover damage resulting from: events outside our control such as earthquakes, floods, or severe storms; improper use or modification of the completed work by the client or a third party; normal wear and tear; or pre-existing conditions that were not part of the scope of work.
To the extent not otherwise specified in the written agreement, the following disclaimer applies: EXCEPT AS EXPRESSLY SET FORTH IN THE WRITTEN PROJECT AGREEMENT, THE SERVICES ARE PROVIDED "AS IS" WITHOUT ANY OTHER WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
To the fullest extent permitted by applicable law, Edinburg Concrete & Masonry will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of a project will not exceed the total amount paid by the client for that specific project. Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you in full.

Nothing in these Terms prevents either party from seeking emergency injunctive relief from a court to prevent irreparable harm.
These Terms and any disputes arising from them are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action arising from these Terms or our services will be brought in the courts located in Hidalgo County, Texas.
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. We encourage you to review these Terms periodically. Continuing to use our website or services after changes are posted means you accept the updated Terms.
